My client, United Collection Bureau, won summary judgment on Plaintiff's claims under the Fair Debt Collection Practices Act (FDCPA). Plaintiff alleged that United falsely represented the amount due on a debt in its collection letters in violation of the FDCPA. The court granted United's motion for summary judgment on the grounds that Plaintiff failed to show that United's letters falsely represented the amount of the debt. The court further found that even if United's letters did violate the FDCPA, United was entitled to a bona fide error defense under the FDCPA and therefore still would have won on summary judgment.

My client, Chase Bank USA, sought and received summary judgment on Plaintiff's claims for violation of the Truth In Lending Act (TILA), breach of contract, and violation of Plaintiff's Constitutional due process rights in connection with Chase's arbitration award against Plaintiff. Chase also counter-sued for confirmation of its arbitration award and won on summary judgment as to that issue, as well.
